Article 1
- This Accommodation Agreement and related agreements entered into by the Hotel with guests are governed by the following terms and conditions. Any matters not provided for herein shall be governed by laws and regulations or generally established customary practice.
- If the Hotel agrees to special terms within the limits of laws and regulations and customary practice, those special terms shall have priority over the provisions in the preceding paragraph. (Application for Accommodation Agreement)
Article 2
- Those who wish to make an Accommodation Agreement (i.e., reservation) at the Hotel must provide the following:
- Name of the person staying
- Dates of stay and expected arrival time
- Accommodation fee (generally, based on the basic accommodation fee in Appendix 1)
- Other items deemed necessary by the Hotel
- In addition to providing the items stipulated in the preceding paragraph, guests must also agree to the following matters:
- Persons staying at the facility must be able to communicate in Japanese or in a supported foreign language.
- Foreign nationals who do not have an address in Japan shall be required to present a passport; Japanese nationals and foreign nationals who have an address in Japan shall be required to present a passport or identification such as a driver's license.
- Adhere strictly to the rules for use of the facility.
- English is the only foreign language supported by the facility.
- If, during their stay, a guest wishes to extend their stay beyond the date specified in item 2 of Paragraph 1, the Hotel will treat this request as a new application for a reservation at the time the request is made. (Establishment of an Accommodation Agreement, etc.)
Article 3
- The Accommodation Agreement shall be considered established when the Hotel accepts the reservation in accordance with the preceding article; provided, however, that this shall not apply if the Hotel can prove that it did not accept the application.
- When the Accommodation Agreement is established according to the provision of the preceding paragraph, the guest shall pay the application deposit set by the Hotel, up to the limit of the basic accommodation fee for the duration of the stay, by the date that the Hotel specifies.
- The application deposit shall first be applied to the accommodation fees finally payable by the guest. In the event of cancellation, etc., it shall be applied first to the penalty charge and then to compensation (damages). Any remaining balance shall be refunded at the time of payment.
- If the application deposit is not paid by the date that the Hotel specifies according to the provision in Paragraph 2, the Accommodation Agreement shall cease to be effective. However, this shall apply only where the Hotel has notified the guest, in specifying the payment due date for the application deposit, to that effect. (Special provision exempting payment of the application deposit)
Article 4
- Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may accept a special provision that the payment of the application deposit set forth in that Paragraph shall not be required after the conclusion of the agreement.
Article 5
- The Hotel may refuse to conclude an Accommodation Agreement in the following cases:
- When the application for accommodation is not made according to these terms and conditions.
- When there are no available rooms due to full occupancy.
- When the Hotel determines that there is a risk that the person seeking accommodation will, in connection with the accommodation, engage in conduct that violates laws or regulations, public order, or good morals.
- When it is recognized that the person seeking accommodation is one of the following:
- An organized crime group as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Law No. 77 of 1991) (hereinafter referred to as an "organized crime group"), a member of an organized crime group as defined in Article 2, Item 6 of the same act (hereinafter referred to as a "member of an organized crime group"), a quasi-member of an organized crime group, or someone related to an organized crime group or other anti-social force
- A corporation or other organization controlled by an organized crime group or their members
- A corporation with officers who are members of an organized crime group
- When the person seeking accommodation has engaged in words or conduct that causes significant nuisance to other guests.
- When it becomes obvious that the person seeking accommodation is a carrier of an infectious disease.
- When, in connection with the accommodation, violent demands are made, or an unreasonable burden exceeding a reasonable scope is demanded.
- When accommodation is not possible due to a natural disaster, facility malfunction, or other unavoidable circumstance.
- When any other reason stipulated by prefectural ordinances applies.
Article 6
- A guest may cancel the Accommodation Agreement by giving notice to the Hotel.
- If a guest cancels the Accommodation Agreement in whole or part due to reasons attributable to the guest (excluding cases where, pursuant to Article 3, paragraph 2, the Hotel has specified the due date for payment of the application deposit and has requested such payment, and the guest cancels the Accommodation Agreement prior to making such payment), the Hotel shall charge cancellation charges as specified in Appendix 2. Provided, however, that where the Hotel has accepted special provisions under Article 4, paragraph 1, the guest's obligation to pay such cancellation charges upon cancellation of the Accommodation Agreement shall apply only if the Hotel has notified the guest of that obligation at the time of accepting such special provisions.
- If, without prior notice, a guest fails to arrive by 10:00 p.m. on the day of commencement of the stay (or, where an expected arrival time has been specified in advance, by the time after such specified arrival time has elapsed), the Hotel may treat the Accommodation Agreement as having been cancelled by the guest.
Article 7
- The Hotel may cancel the Accommodation Agreement in the following cases:
- When the Hotel determines that the guest is likely to engage, in connection with the accommodation, in acts that violate laws and regulations, public order, or good morals, or that the guest has engaged in such acts.
- When the Hotel determines that the guest falls under any of the following:
- An organized crime group, member of an organized crime group, a quasi-member of an organized crime group, or any other anti-social force
- A corporation or other organization controlled by an organized crime group or their members
- A corporation with officers who are members of an organized crime group
- When the guest has engaged in behavior that significantly disturbs other guests.
- When it becomes obvious that the guest is a carrier of an infectious disease.
- When, in connection with the accommodation, violent demands are made, or when the guest requests the Hotel to assume a burden beyond a reasonable scope.
- When the accommodation cannot be provided due to force majeure such as a natural disaster.
- When the guest fails to comply with prohibited matters set forth in the Hotel's Rules of Use (limited to those necessary for fire prevention), including smoking in bed in guest rooms, tampering with fire-fighting equipment or other fire safety facilities, or other prohibited acts.
- If the Hotel cancels the Accommodation Agreement based on the provisions of the preceding paragraph, the Hotel will not charge for accommodation services that have not yet been provided to the guest.
Article 8
- On the day of arrival, the guest shall register the following particulars at the Hotel front desk:
- The guest's name, age, gender, address, and occupation
- In the case of a foreign national, the guest's nationality, passport number, port of entry, and date of entry
- The date of departure and the scheduled time of departure
- Any other matters deemed necessary by the Hotel
- Where the guest intends to pay the charges referred to in Article 12 by traveler's check, accommodation voucher, credit card, or any other means in lieu of currency, the guest shall present the same in advance at the time of registering the particulars set forth in the preceding paragraph.
Article 9
- The hours during which a guest may use a guest room of the Hotel shall be from 3:00 p.m. to 10:00 a.m. on the following morning. Notwithstanding the foregoing, in the case of a continuous stay for consecutive nights, the guest may use the guest room for the entire day, except on the arrival date and the departure date.
- Notwithstanding the provisions of the preceding paragraph, the Hotel may, at its discretion, accept requests for use of a guest room outside the hours set forth in the same paragraph. In such case, the following additional charges shall be collected:
- 10% of an amount equivalent to the room charge for each hour of extension
- 100% of an amount equivalent to the room charge for an extension of five hours or more
Article 10
- Guests shall, while within the Hotel, comply with the Rules of Use prescribed by the Hotel and posted within the Hotel.
Article 11
- The operating hours of the Hotel's principal facilities are as follows. The operating hours of other facilities are provided in brochures made available at the Hotel, notices posted in various locations, and the service directory in guest rooms:
- Front Desk: 8:00 AM to 10:00 PM
- 1F Sauna Area: 8:00 AM to 10:00 PM
- Art Gallery: 8:00 AM to 10:00 PM
Article 12
- The breakdown of the accommodation fee to be paid by guests is as specified in Appendix 1.
- Payment of the accommodation charges, etc. set forth in the preceding paragraph shall be made at the front desk, upon the guest's departure or upon the Hotel's request, in currency or by any other method accepted by the Hotel, including traveler's checks, accommodation vouchers, or credit cards.
- Where the Hotel has provided a guest room to the guest and the room has become available for use, the Hotel shall charge the accommodation charges even if the guest voluntarily does not stay.
Article 13
- The Hotel shall compensate the guest for any damage incurred by the guest in connection with the performance of the Accommodation Agreement and any agreements related thereto, or for any damage incurred by the guest as a result of non-performance thereof; provided, however, that this shall not apply where such damage is not attributable to reasons for which the Hotel is responsible.
- The Hotel has a liability insurance policy for accommodations in order to respond to contingencies such as fire.
Article 14
- If the Hotel is unable to provide the guest with the room agreed upon under the contract, the Hotel shall, with the guest's consent, arrange alternative accommodation under the same conditions as far as possible.
- Notwithstanding the preceding paragraph, if the Hotel is unable to arrange alternative accommodation, the Hotel shall pay the guest compensation equivalent to the amount of the cancellation charges, and such compensation shall be applied toward the amount of damages. However, no compensation shall be paid if the Hotel's inability to provide the room is due to reasons not attributable to the Hotel.
Article 15
- If luggage or personal belongings are left behind by a guest at the Hotel after checkout and the owner is identified, the Hotel shall contact the owner and seek instructions. However, in the absence of instructions from the owner or if the owner cannot be identified, the Hotel shall keep the items for seven days, including the date of discovery, and shall dispose of them thereafter.
Article 16
- Where a guest uses the Hotel's parking lot, the Hotel merely provides a parking space and does not assume responsibility for the custody or management of the vehicle. Notwithstanding the foregoing, if the Hotel causes damage through its willful misconduct or negligence in managing the parking lot, the Hotel shall be responsible for compensating such damage.
Article 17
- If the Hotel suffers any damage as a result of the willful misconduct or negligence of a guest, the guest shall compensate the Hotel for such damage.
(Appendix 1) Breakdown of accommodation fees, etc. (related to Article 2, Paragraph 1 and Article 12, Paragraph 1)
Total amount payable by the guest
- Accommodation fee: Basic accommodation fee (room rate (or room rate + fees for meals and beverages such as breakfast))
- Fees for additional food and beverage (excluding those included in the basic accommodation fee)
- Fees for fixtures, furnishings, and equipment (artworks or furniture and appliances)
- Consumption tax
Notes:
- The basic accommodation fee is based on the rate table posted on the website.
- Fees for children aged 6 and under:
- Free if no bedding is provided
- If bedding is provided, the charge shall be the fee applicable to one adult
(Appendix 2) Cancellation charges (related to Article 6, Paragraph 2)
Date on which notice of cancellation of the agreement is received
- No-show: 100% of the basic accommodation fee
- One day prior: 100% of the basic accommodation fee
- Seven days prior: 50% of the basic accommodation fee
- Fourteen days prior: 20% of the basic accommodation fee
Note:
If the agreement period is shortened, a cancellation charge for the reduced days will be charged regardless of the number of days by which it is shortened.
